  1. Payment Terms
We are able to provide paid services because of the service. In this instance, we are allowed to process payments through third-party services. Your payment card number won't be stored or collected by us. This information is immediately given to the external payment providers, and their privacy policies govern how they use their customers' personal data. These entities' payment processors abide by the PCI Security Standards Council (PCI SSC) PCI-DSS security guidelines, which were developed in conjunction with businesses including Visa, Mastercard, American Express, and Discover. A secure management of payment data is ensured by PCI-DSS requirements.
  1. User Content
You hereby grant us, our affiliates, service providers, and users a non-exclusive, transferable, sublicensable, worldwide license to use, store, publicly perform, reproduce, save, modify, create derivative works, monetize, download, translate, and distribute your User Content, including for the promotion and redistribution of all or a portion of the Ask Robot Service, by posting any User Content on the Service. Nothing exists in these circumstances: grants you the right to receive payments or a share of the profits from using content created by users in accordance with other licenses. Without warning and at our discretion, we reserve the right to update, delete, or otherwise modify user content submitted to AskRobot.
  1. Termination of Service
AskRobot may terminate or suspend your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate your account, you may simply discontinue using the Service.
  1. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance. AskRobot and its affiliates, subsidiaries, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.
  1. Limitation of Liability
In no event shall AskRobot, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
  1. Indemnification
You agree to indemnify and hold AskRobot and its affiliates, officers, agents, employees, and partners harmless from and against any and all claims, liabilities, damages (actual and consequential), losses and expenses (including attorneys' fees) arising from or in any way related to any third-party claims relating to your use of the Service or violation of these Terms.
  1. Dispute Resolution
For disputes starting after the date these Terms became effective, Section 11 does not apply to you if you are a consumer in the European Economic Area (EEA) or the United Kingdom (UK).
In the event that you have a problem with us, you agree to attempt an informal resolution by first contacting us. Neither party may begin any legal action, whether in court, arbitration, or any other forum, until the Notice of Dispute and Informal Dispute Resolution procedures outlined below are finished. However, nothing in this Section shall prevent you or us from seeking temporary injunctive relief in a court (or in arbitration) to maintain the status quo or to help enforce this arbitration provision.
The first step in any dispute is for the parties involved to send us a dispute notification. This notice must include your full name, your AskRobot profile name, the email address linked to your AskRobot account, your country of residence and, if you're an American resident, your state of residence, your attorney, if one is acting on your behalf, and your signature. This information should be sent through {insert email} to the listed legal address. Within 60 days of receiving the notice of dispute, AskRobot will respond in an effort to settle the issue amicably. One of the parties may begin the arbitration process once the sixty-day period has passed.
Arbitration: We undertake to settle any claim, disagreement, or controversy arising out of or connected to these Terms or the Service through binding arbitration or, for certain claims, through a small claims court if the matter cannot be settled through the procedures outlined above.
By agreeing to these Terms, you and AskRobot both waive any right to a jury trial or the right to take part in a class action. You also agree that the interpretation and enforcement of this Section shall be governed by the U.S. Federal Arbitration Act. Any disagreements pertaining to the interpretation, legality, or validity of this mandatory arbitration agreement must also be settled by the arbitrator alone.
The American Arbitration Association (AAA) shall handle all arbitrations in accordance with the relevant AAA rules that are currently in effect. The Termes, however, shall govern in the event that the AAA rules conflict in any way with them. The AAA forms are available at www.adr.org. In a written decision supported by the arbitrator, the essential conclusions and the conclusions upon which the attribution is based must be stated. Any competent court may render a decision regarding the arbitrator's attribution. In accordance with the AAA's Consumer Arbitration Rules, the arbitrator must allocate all fees and costs related to the arbitration to the party whose claim the arbitrator finds to be frivolous or made for an improper reason.
Each party should bring any disagreements in their individual capacity, not as a participant in a class action or other representative procedure. You understand that by agreeing to these conditions, you are waiving your right to a jury trial and class action participation.
Nothing included in these agreements shall affect your non-waivable statutory rights. You agree that any dispute will only be resolved in accordance with section 12 of these terms if it cannot be resolved through arbitration under applicable law or in another way.
  1. Updates to Services
Our service terms are subject to change on occasion. The most recent service terms will be published on this page in order to keep you informed of any changes. We will let you know via email and/or a clear notice on our service before the change takes effect. The "least recent update" date will also be updated in the section above these terms of service. It is advised that you regularly review our service terms to be abreast of any changes. The changes to these service terms will take effect when they are published on this page.
  1. Third-party links
Links to other websites, that are not operated or maintained by AskRobot may be included in the service. The information you supply with Third Party Sites will be governed by their individual privacy policies and terms of service, not by our Terms of Service. By providing these links, we do not imply that we support or have examined the sites in question. Please get in touch with third-party websites directly to learn more about their terms of service.
  1. Warranty
As long as it is permitted by applicable law, all of the content and services on AskRobot are provided "as is," without any express or implied warranties.
Any guarantee of merchantability, suitability for a particular purpose, and lack of violation is expressly rejected by AskRobot, as is any guarantee arising from the transaction or use of the transaction.
AskRobot will not be liable for any user content that you or another person posts or sends via the service. You understand and accept that there is a chance you will encounter user content that is unreliable, offensive, improper for kids, or otherwise inappropriate for your intended audience.
We make no promises as to the accuracy, timeliness, or completeness of AskRobot, any component of the service, or any information or content made available by AskRobot. We also make no promises as to the security, continuity, or absence of bugs, viruses, or other harmful elements in any of the above.
We can change AskRobot for a variety of reasons. We are not responsible for any changes made to AskRobot or for any restrictions placed on your use of AskRobot or for any interruptions to those services.
The restrictions, exclusions, and declarations listed in this section apply up to the maximum allowed by the relevant legal framework.
We do not exclude or reduce our responsibility for wrongful death or other serious injury brought on by our negligence or willful misconduct if you reside in the European Economic Area (EEA) or the United Kingdom (UK).
  1. Jurisdiction
The courts in the State of Delaware shall have exclusive jurisdiction to settle any dispute or claim arising out of, or in connection with, this Terms of Service, its subject matter and formation.
  1. Entire Agreement & Severability
These Terms include the whole service agreement between you and us. If any term of these Terms is found to be unenforceable, that provision must not be enforced to the least extent possible and the other clauses shall be enforced in full effect.
